TERMS OF SERVICE

1. SCOPE
These Terms of Service ("Terms") govern all sales of products made through this website (the "Site") between Osteane ("we", "us") and any customer purchasing as a consumer ("you"). Placing an order constitutes full acceptance of these Terms. We may amend these Terms at any time; the version in force at the time of your order applies to that order.
2. PRODUCTS
Our products are described and presented as accurately as possible. Photographs and visuals are illustrative, and minor variations in appearance do not constitute a defect. Products are offered subject to availability.
3. PRICES
Prices are shown in US dollars and exclude any shipping charges, which are displayed before you confirm your order. Prices do not include any sales tax, duties or import charges that may apply in your jurisdiction; where these are collected at checkout they will be shown separately before payment. We may change our prices at any time, but your order is charged at the price displayed when you confirmed it.
4. ORDERS
You select your products, review your cart, and confirm your order after accepting these Terms. The sale is concluded once we send you an order confirmation by email. We reserve the right to refuse or cancel any order, including where the product is unavailable, where the price was displayed in error, or where there is an unresolved payment dispute on a previous order. If we cancel an order you have already paid for, we will refund you in full.
5. PAYMENT
Payment is taken online at the time of order by credit or debit card (Visa, Mastercard, American Express), Apple Pay, Shop Pay, PayPal or Klarna. Payments are encrypted and processed directly by our payment providers; we never store your card details. Your order is only processed once payment has been authorised.
6. SHIPPING
Products are shipped to the address you provide at checkout. Shipping costs and estimated delivery times are shown before you confirm your order and repeated in your confirmation email. A tracking number is sent as soon as your order ships. Full details are set out in our Shipping Policy. Delivery estimates are estimates, not guarantees. Risk of loss passes to you on delivery. 7. RETURNS, REFUNDS AND OUR GUARANTEE
Our returns and refunds terms are set out in our Returns & Refunds Policy, which forms part of these Terms. In summary, you benefit from our 60-day money-back guarantee: if you are not satisfied within 60 days of delivery, we will refund you in full and you do not need to return the product. One refund per customer applies under this guarantee.
8. PRODUCT USE AND HEALTH DISCLAIMER
Osteane products are cosmetic products intended for external use on the skin. They are not medical devices and are not intended to diagnose, treat, cure or prevent any disease. These statements have not been evaluated by the Food and Drug Administration.
Patch test before first use. Discontinue use and consult a healthcare professional if irritation occurs. Do not use on broken, inflamed or sunburned skin. Keep out of reach of children. If you are pregnant, breastfeeding, or have a skin condition or any medical concern, consult a healthcare professional before use.
9. DISCLAIMER OF WARRANTIES
Except as expressly stated in these Terms and in our Returns & Refunds Policy, and to the fullest extent permitted by law, the Site and the products are provided "as is" and we disclaim all other warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, our total liability arising out of or relating to your purchase shall not exceed the amount you paid for the product concerned. We shall not be liable for any indirect, incidental, special, consequential or punitive damages. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence. We are not liable for failure to perform caused by events beyond our reasonable control.
11. PROHIBITED USES
You may not use the Site for any unlawful purpose, to solicit others to perform unlawful acts, to infringe our or any third party's intellectual property rights, to submit false or misleading information, to upload malicious code, to collect or track the personal information of others, or to interfere with the security features of the Site.
12. PERSONAL DATA
We process your personal data as described in our Privacy Policy, available on the Site.
13. INTELLECTUAL PROPERTY
All content on the Site, including text, images, logos and the Osteane name, is protected by intellectual property law and remains our exclusive property. Reproduction or use without our permission is prohibited.
14. CUSTOMER SERVICE
For any question, request or complaint about an order, a product or a delivery, contact us at contact@osteane.com. We aim to reply within 24 hours and to resolve any difficulty amicably.
15. GOVERNING LAW AND DISPUTES
These Terms are governed by French law, without prejudice to any mandatory consumer protection provisions of the jurisdiction in which you reside. We will always try to resolve any dispute amicably first; please contact us before taking any other step. Failing an amicable resolution, the competent French courts shall have jurisdiction, without prejudice to any right you may have to bring proceedings in the courts of your own jurisdiction where applicable law so provides.
16. SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force.
